Booking terms and conditions of Moana Tours Ltd.

Definitions

In these booking terms and conditions, the following terms are defined as stated below:

  1. Traveller: the party with whom Moana Tours Ltd. has concluded or intends to conclude an agreement or at least anyone using the travel services under the agreement.
  2. Travel service: a service concerning passenger a) transport, b) accommodation during the trip or c) holiday or other tourist services that do not form a material part of a travel service as referred to under a or b.
  3. Package tour: a combination of at least two kinds of travel services during one trip or holiday including at least one overnight stay.
  4. Agreement: every agreement concluded between Moana Tours Ltd. and the traveller that concerns travel services.
  • General provisions
  1. These booking terms and conditions apply to all offers of Moana Tours Ltd. and to every agreement that is concluded between Moana Tours Ltd. and a traveller.
  2. The applicability of any general terms and conditions of the traveller is explicitly excluded.
  • Agreements
  1. Every offer made by Moana Tours Ltd. to the traveller is without obligation and subject to sufficient availability of the travel services or package tour offered.
  2. Every agreement is concluded when Moana Tours ltd. confirms the booking with a written notice. Moana Tours ltd will only confirm the booking when the offer of Moana Tours Ltd. is accepted by the traveller within the validity period if stated in the offer for this purpose and if the traveller fulfilled all the conditions stated in the offer, including paying a deposit. A receipt of the deposit and booking form by Moana Tours Ltd. does neither guarantee nor imply confirmation of the booking.
  3. Moana Tours ltd. reserves the right to refuse a booking without giving any reason and shall in that event return any deposit received.
  • Responsibilities of the traveller
  1. The traveller is responsible for arranging his or her own travel and/or cancellation insurance at his or her own expense and risk.
  2. The traveller is responsible for arranging the documents that are required to travel to Tanzania, such as a valid passport, visa, or other documents that are required according to the laws or regulations in the country of destination and the country of origin.
  3. If the traveller’s behaviour is (potentially) causing a nuisance or trouble which (potentially) severely impedes the proper execution of the agreement, the agreement can be discontinued by Moana Tours Ltd. All damage or loss resulting from such situation will be at the expense of the traveler.
  • Cancellation or changes
  1. The paragraphs below about the cancellation of an agreement apply to the travel services offered, upon payment of the deposit and confirmation of the reservation.
  2. If the traveller cancels all or part of the agreement other than a package tour, such as a single day trip or another single travel service, Moana Tours Ltd. continues to be entitled to full payment of the agreed price.
  3. In the event of cancellation of a package tour by the traveller, the traveller owes Moana Tours ltd the following costs:
  • up to the 56th day before the start of the package tour: 25% of the agreed price;
  • from the 56th day up to the 42nd day before the start of the package tour: 40% of the agreed price;
  • from the 42nd day up to the 28th day before the start of the package tour: 50% of the agreed price;
  • from the 28th day up to the 14th day before the start of the package tour: 75% of the agreed price;
  • from the 14th day before the start of the package tour: the full price agreed.
  1. Moana Tours Ltd. reserves the right to terminate, at the discretion and with immediate effect, the participation of any person at the tour in cause of a nuisance or trouble which (potentially) severely impedes the proper execution of the agreement.
  2. Moana Tours Ltd. will make every effort to adhere to the confirmed itinerary. However, where involuntary changes are significant– such as change of accommodation or transportation – Moana Tours ltd. undertakes:
    1. To provide a reasonable alternative at no additional cost.
    2. In the event that you reject the reasonable alternative provided or should a reasonable alternative not be available, to refund you the payment directly arising from the involuntary change(s).
  • Suspension and dissolution
  1. If reasonably justified by the circumstances of the event, Moana Tours Ltd. will be entitled to suspend the execution of the agreement or to fully or partially dissolve it with immediate effect if and insofar as the traveller fails to fulfil his obligations under the agreement.
  2. The traveller can never claim any form of compensation in connection with the right to suspension or dissolution being exercised by Moana Tours Ltd. in case of the situation as described under 1.
  • Payment
  1. The total price, including taxes and other costs, will be stated upon conclusion of the agreement at the latest. This will take place when Moana Tours Ltd. sends the confirmation to the traveller.
  2. Payment must be made in the currency and manner as indicated by Moana Tours Ltd..
  3. Unless expressly agreed otherwise, 25% of the travel sum of a package tour must be paid by the traveller in the form of a deposit, no later than seven days after the date that the confirmation is sent by Moana Tours Ltd.. The remaining balance must be paid no later than six weeks before departure. If departure is within six weeks, the full travel sum must be paid no later than five days after the invoice date or if departure is earlier, before departure at the latest.
  • Liabilty in general
  1. The liability of Moana Tours Ltd. exists exclusively to the extent provided for in these booking terms and conditions.
  2. Moana Tours Ltd. is not liable for damage or loss resulting from delays, strikes, changes in transport, cancellations in transport services due to terrorist attacks, weather conditions, natural disasters, bankruptcies of carriers or other forms of force majeure.
  3. Moana Tours Ltd is not liable for indirect damage or loss, such as loss of profits, damage to luggage, loss of monetary means, loss of negotiable documents or other items of value.
